The parties agreed to a class settlement valued at $77.5 million, a historic result that represents the largest ever securities litigation recovery in Utah. GeneralCounselsuccessfullydefendedLAFPPin a federal lawsuit, Williams v. City of Los Angeles et al. (U.S.D.C., C.D. Cal. Case No. 22-cv-05640-CJC-JC), in which the Board and Plan staff were named as defendants. The plaintiff was LAFPP Member Ronald Williams, who retired from LAPD on August 1, 1987. TheUnitedStatesDistrictCourtfortheCentral DistrictofCaliforniagrantedLAFPPsmotionto dismiss the case. On April 30, 2024, the Ninth Circuit Court of Appeals affirmed this dismissal, citing a lack of subject matter jurisdiction. GeneralCounselalsosuccessfullydefended LAFPPintwopetitionsforwritofmandamus. ThefirstactionwasbroughtbyLAFPPMember John Nguyen in Nguyen v. Los Angeles City Fire andPolicePensionSystem(L.A.S.C.CaseNo. 22STCP03218), in which he sought to invalidate the Boardsdecisiontogranthimanonservice-con-nected disability pension. The second action was brought by the surviving spouse of LAFPP Member James Rousseve in Rousseve v. Los Angeles City Fire and Police Pension System (L.A.S.C. Case No. 23STCP02353),inwhichshesoughttoinvalidate the Boards decision to grant her a nonservice-con-nectedsurvivingspousepension.Inbothcases, the Court found that the Petitioners did not meet their evidentiary burdens and upheld the Boards decisions.SECTION 7 Legal 145'
